New bill aiming to establish legal limit for THC in driver’s system

A new bill in Indiana aims to establish a legal limit for tetrahydrocannabinol (THC) in a driver’s system.
The bill, authored by representatives Wendy McNamara and Steve Bartels, proposes that a driver would be considered intoxicated if they have at least five nanograms of THC in their saliva as detected by a qualified test.
The bill specifies the use of an oral fluid test performed by a “Dragger DrugTest 5000” as a qualified test.
Under current law in Indiana, a driver could be charged with operating a motor vehicle while intoxicated if any measurable amount of THC is detected in a suspect’s blood.
