Second trial possible in South Bend Police wiretapping case

A second trial could be coming in the South Bend Police tape scandal.

The case was the subject of a federal bench trial in 2014, with a verdict that was later vacated as the case was remanded to state court.

Bob Palmer, the Attorney General for the South Bend Common Council, recently filed a request for a jury trial. On Monday, the Common Council argued a motion that requests the police officers involved in the scandal should not be allowed to participate in future proceedings, due to a settlement reached with the city in federal court.

Determining just who can participate in the proceedings will take at least two months before the judge is expected to consider future motions.

Attorneys for the officers and the city have until Jan. 3 to file a response to the Common Council’s motion.
