Four St. Joseph County police officers are appealing a judge’s January ruling on the wiretap scandal in hopes of keeping the contents of one of the tapes from being publicly released.

Officers Tim Corbett, Steve Richmond, Dave Wells, Brian Young and Young’s wife, Sandy Young, filed an appeal notice on Tuesday, Oct. 13, stating their intent to appeal the ruling to the U.S. Court of Appeals for the Seventh Circuit, according to the South Bend Tribune.

The appeal deadline is Oct. 15.

A judge ruled in January that any tapes made after the tapes were first discovered on Feb. 4, 2011, violated the Federal Wiretap Act and therefore couldn’t be released. Tapes made before that weren’t in violation of the law because they weren’t intentionally recorded, but it’s not clear if the tapes violated other state or federal laws.

One of the tapes was made before that date, South Bend Mayor Pete Buttigieg said in January, and city lawyers are deciding whether or not it can be publicly released, the Tribune reported.
