Cromwell man arrested on charges connected to 2014 moped death

Two and a half years later, James Fugate has been arrested after allegedly causing a fatal moped crash.

The Elkhart County Sheriff’s Department arrested the Cromwell man on Sunday, nearly two years after charges were filed against him for causing death when OWI and causing death when operating a motor vehicle while intoxicated, according to ABC 57.

Fugate was behind the wheel of a vehicle on County Road 38 at about 5:30 a.m. on August 29, 2014. Fugate claims he didn’t see a moped in front of him and couldn’t stop in time to prevent the fatal crash that killed 24-year-old Jennifer Myers.

Fugate also reportedly admitted that he smoked marijuana before the crash. His claim was backed up by a witness, who says Fugate was driving erratically prior to the crash, nearly going off the road a few times as well as crossing the center line.

A blood draw later revealed the presence of THC, Alprazolam and Methadone in his system. He didn’t have a prescription for any of them, according to court documents.

Charges against Fugate were filed in June of 2015.
